Terms of service
These Terms of Service ("Terms") govern your use of keepfound, including the website keepfoundmultifamily.com and the app at app.keepfound.ai. keepfound is operated by keepfound LLC ("keepfound," "we," "us"). By creating an account or using the service, you agree to these Terms on behalf of yourself and the business you represent ("you"). If you do not agree, do not use keepfound.
1. The service
keepfound monitors how AI search tools, such as ChatGPT, Perplexity and Google AI Mode, answer questions about apartment communities. It runs searches on a schedule and reports which communities are named, which sources are cited, and related visibility measures. We may add, change or remove features over time. We may also add, change or stop tracking specific AI tools, for example when a provider changes or limits access. keepfound does not control or change what AI tools say, and does not submit content to them on your behalf.
2. Who can use keepfound
keepfound is offered to businesses, and to people acting on behalf of a business, located in the United States. You must be at least 18 and able to enter a binding contract. By using keepfound you confirm that you are in the United States and that you are authorized to act for the business and for any property you add as your own. You may also add other communities, such as competitors, to track their public information; you do not need to represent those.
Properties and competitors. A "Property" is an apartment community you own, or manage or market for its owner, and add to keepfound as your own. A management company may add Properties it runs for owners it does not control, as long as it is authorized to act for them. A "Competitor" is any other community you choose to track. If you sell or stop managing a Property, remove it from your account. Its history stays with your account unless you ask us to delete it.
3. Your account
You are responsible for your account, for keeping your login secure, and for everything done under it, including by users you invite. Tell us promptly at support@keepfound.ai if you believe your account has been accessed without permission.
4. Plans, properties and fees
keepfound is sold as a monthly or annual subscription. Each plan includes a set number of properties, tracked prompts and other limits, as shown on our pricing page and in your account. You may buy additional properties on top of your plan. Prices are in US dollars. Applicable sales tax is calculated at checkout.
Order forms. If you sign a quote or order form with us, for example for a portfolio or agency deal, it becomes part of these Terms and controls wherever the two conflict.
5. Payments through Paddle
Our order process is conducted by our online reseller, Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. When you subscribe, you also agree to Paddle's Buyer Terms. Your payment details are handled by Paddle, and we do not store your full card number.
6. Billing, renewals and changes
- Renewal. Your subscription renews automatically at the end of each billing period, monthly or annually, until you cancel. The card on file is charged at each renewal.
- Upgrades and added properties. When you move to a higher plan or add properties, the change takes effect immediately. You are charged a prorated amount for the rest of the current billing period that day.
- Downgrades and removed properties. When you move to a lower plan or remove properties, you keep your current plan and properties until the end of the billing period you've paid for. The lower price applies from your next renewal. No credit or partial refund is given for the remainder of the current period.
- Failed payments. If a payment fails, an upgrade or addition does not take effect. If a renewal payment fails and is not resolved, we may limit or suspend your access until it is.
- Price changes. We may change our prices. We will give you at least 30 days' notice before a new price applies to your subscription, and it will take effect at a renewal after that notice.
7. Founder pricing
We may offer founding-customer pricing to a limited number of early customers. Founder pricing stays in place for as long as your subscription remains active, including if you change plans. If you cancel, or your subscription ends for non-payment, founder pricing ends and is not restored if you subscribe again. We decide eligibility, and the offer may end at any time for new customers. Other promotional or pilot discounts apply only to the period stated in the offer and do not carry over to renewals.
8. Cancellation
You can cancel at any time through Manage billing in your account. Cancellation takes effect at the end of your current billing period. You keep access until then, and you will not be charged again. We do not provide refunds for the unused part of a billing period, except as described in our Refund Policy.
9. Acceptable use
You agree not to:
- claim to represent a property or business you are not authorized to act for;
- resell, sublicense or share access to keepfound outside your organization, except with users you invite to your account;
- copy, scrape or reverse-engineer the service, use its outputs to train an AI model or build a competing product, or attempt to bypass its limits or security;
- use keepfound or its outputs to break any law, including fair housing laws, to mislead renters, to make unverified claims about Competitors based on AI answers, to infringe anyone's intellectual property, or to send spam or commit fraud.
We may suspend or close accounts that break these rules.
10. AI results and no guarantees
keepfound reports what third-party AI tools say at the time of each search. Those tools are not controlled by us, and their answers change often and can be inaccurate. That includes what they say about your Competitors: those are the AI tools' statements, not ours. Recommendations in keepfound are suggestions only. We do not guarantee any visibility, ranking, mention, traffic, lead, lease or occupancy result. You are responsible for decisions you make based on keepfound.
11. Your data and our property
You keep ownership of the information you provide about your business and properties. You give us permission to use it to run and improve the service. We may access your account to provide support or fix problems. We may also create de-identified, aggregated data from use of keepfound, such as industry benchmarks, and use it during and after your subscription, as long as it does not identify you, your company or your Properties. You can download your reports as PDFs at any time while your subscription is active, so download what you need before it ends. After it ends, we delete your data as described in our Privacy Policy. keepfound itself, including its software, design and reports format, belongs to keepfound LLC. Our Privacy Policy explains how we handle personal information.
Your name and logo. We may name your company as a keepfound customer and show your company name and logo on our website and in marketing materials, following any brand guidelines you give us. To opt out, email support@keepfound.ai and we'll remove them within 30 days. An order form can set different terms.
12. Availability and changes
We work to keep keepfound available but do not promise uninterrupted service. Scheduled scans may be delayed or skipped because of issues with third-party AI tools or our providers. We may update these Terms. If a change is material, we will notify you by email or in the app before it takes effect. Continuing to use keepfound after that means you accept the updated Terms.
13. Disclaimers and limitation of liability
keepfound is provided "as is" and "as available," without warranties of any kind, including warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows. To the fullest extent the law allows, keepfound LLC is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, business, goodwill or data, even if we were told they were possible. Our total liability for all claims relating to keepfound, combined, is limited to one month of the fees for your plan at the time of the claim. Any claim against us must be brought within one year after it arises.
Claims caused by your use. You will defend and indemnify keepfound LLC against third-party claims, and the related losses and reasonable legal fees, that arise from your data, your use of keepfound or its outputs, or your breach of these Terms. That includes claims under fair housing laws and claims by Competitors.
14. Termination
You may stop using keepfound at any time by cancelling. We may suspend or end your access if you break these Terms or fail to pay. Sections that by their nature should survive termination, including 10, 11 and 13, will survive.
15. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in California.
